Terms of Service (TreeUmph! Adventure Course)

These Terms of Service (“Terms”) apply to your use of www.treeumph.com (the “Site”) and any reservations, ticket purchases, or other transactions you make through the Site. The Site is operated by TreeUmph! Adventure Course (“TreeUmph,” “we,” “us,” or “our”).
By using the Site, or by purchasing/reserving tickets, you agree to these Terms.
1) Who These Terms Apply To
You agree that:
You are at least 18 years old, or you are using the Site with the involvement/permission of a parent or legal guardian.
If you purchase tickets or sign waivers for a minor, you confirm you are the minor’s parent/legal guardian or otherwise authorized to do so.
2) Reservations, Tickets, and Check-In
When you book a reservation or purchase tickets:
You agree to provide accurate contact and payment information.
You are responsible for arriving on time and following all staff instructions.
Participation requirements (such as supervision rules for minors, reach/height rules, course eligibility, etc.) are posted on the Site and may apply to your booking.
We may refuse entry or remove participants who do not meet safety requirements or do not follow instructions.
3) Waivers, Assumption of Risk, and Safety Rules
TreeUmph activities involve inherent risks (including but not limited to falls, collisions, equipment issues, weather-related hazards, and physical exertion). By purchasing tickets and/or participating:
You acknowledge and accept these risks.
You agree to follow all posted rules and staff directions.
You understand that a waiver is required, including for minors (to be completed/signed by a parent/guardian where applicable).
Important: These Terms do not replace any waiver you sign. The waiver and safety rules may include additional terms.
4) Pricing, Charges, and Payment
Prices are shown at the time of purchase and may change at any time. Your payment method will be charged as part of completing a reservation/purchase. Taxes/fees (if any) may be added at checkout.
5) Cancellation and Rescheduling Policy
Our cancellation and rescheduling rules are posted on the Site and are incorporated into these Terms.
Refunds require at least 48 hours notice.
We can reschedule up until the time of your scheduled climb.
To cancel or reschedule, you can follow the reschedule link that is in your email order confirmation.

6) Weather Policy
TreeUmph is generally a rain or shine activity. By purchasing a ticket, you agree that refunds or rain checks are not given for wet, hot, or cold weather as described on our Weather Policy page.
For severe weather closures (e.g., lightning/high winds), procedures, wait-time expectations, and any offered return options are described in our posted Weather Policy and are incorporated here.
7) Clothing and Equipment Requirements
All climbers must follow clothing and equipment rules, including the requirement to wear closed-toed shoes, and any other requirements posted on the Site or communicated by staff.
8) Promotions, Discounts, Gift Certificates
Promotions and discounts may have separate terms (eligibility, valid dates/times, ID requirements, non-combinability, etc.). We may void a discount if eligibility requirements aren’t met. (Example: promotions requiring proof/ID at check-in.)
9) Text Messages and Communications
If you provide your phone number and opt in (or otherwise authorize messages), you agree you may receive texts related to your reservation or customer service. You can cancel the SMS service at any time. Just text "STOP" to 941-322-2130. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages
As always, message and data rates may apply for any messages sent to you from us and to us from you. The number of messages you will receive will vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

10) Acceptable Use of the Site
You agree not to:
Attempt to break, hack, or disrupt the Site or its systems
Use the Site for unlawful, misleading, or abusive activities
Copy or scrape Site content without permission
Interfere with other users’ access to the Site
11) Intellectual Property
The Site and its content (logos, photos, text, videos, graphics, and design) are owned by TreeUmph or its licensors and are protected by intellectual property laws. You may not use our content for commercial purposes without written permission.
12) Third-Party Services
Some features may rely on third-party services (such as booking tools, payment processors, maps, or embedded content). We are not responsible for third-party services or their policies.
13) Disclaimers
The Site and services are provided “as is” and “as available.” We do not guarantee the Site will always be available, error-free, or uninterrupted.
14) Limitation of Liability
To the fullest extent permitted by law, TreeUmph will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenues, arising from your use of the Site or participation in activities.
If liability is found despite the above, TreeUmph’s total liability will be limited to the amount you paid for the applicable ticket/reservation giving rise to the claim.
15) Indemnification
You agree to defend, indemnify, and hold harmless TreeUmph and its owners, employees, and agents from claims, liabilities, damages, and expenses arising out of your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.
16) Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws rules. Any dispute will be brought in the state or federal courts located in Florida, unless a different process is required by applicable law.
17) Changes to These Terms
We may update these Terms from time to time. The “Effective Date” above will reflect the latest version. Continued use of the Site after changes means you accept the updated Terms.
